Terms and Conditions

Payment

A non-refundable retainer is due upon signing of the contract.
If the client wishes for the hired equipment to remain for a time more than the service period agreed in the contract, the overage in rental time will be billed to the operator at the rate of £75 per hour.
Payment for any overages is due 14 days after client’s event.

Photo Booth

Client will arrange for an appropriate space for the photo booth at the events venue, (8’ deep x 6’ wide x 6’ high). Space must be level and solid

It is client’s responsibility to ensure suitable access is possible.

UpStylePhotos staff can gain access to the desired set-up area at least 60 minutes prior to the scheduled start time.

Client is responsible for ensuring that a suitable power supply is available for the photo booth.

If client does not arrange for provider to fit into a venue, check to ensure access, provider’s choice of location and client did not meet the terms set within this contract, client will forfeit all payments received.

UpStylePhotos agrees to have the Photos photo booth operational for a minimum of 80% of the hire period. Occasionally operations may need to be interrupted for maintenance of the photo booths i.e. replacing ink/paper.

Candy Cart

It is the customers responsibility to seek permission from the venue and to ensure there is enough space for the sweet cart at the venue. The dimensions of the large cart are: (2.5’ deep x 4.5’ wide x 6.5’ high).

Maximum of 6 hours hire of candy cart; the provider will ensure the cart is in place before it is needed at an agreed time with both the client and venue.

There is suitable access to the venue to allow UpStylePhotos staff to unload and reload the cart.

Once the sweet cart is set up it can only be moved by a representative of UpStylePhotos.

Due to insurance and product traceability reasons, you are not permitted to mix your own sweets with sweets provided from UpStylePhotos.

All sweets left at the end of the event will be bagged, and either distributed between the tables or left for the client.

If client does not arrange for provider to fit into a venue, check to ensure access, provider’s choice of location and client did not meet the terms set within this contract, client will forfeit all payments received.

Nut Allergy and Safety Warnings

Please note that some of the sweets may contain or have traces of nuts or nut oils; or may have been made alongside other products containing nuts. UpStylePhotos cannot be held responsible for any issues resulting from food allergies.

A file of all sweet ingredients and allergens will be attached to the cart for your information. UpStylePhotos makes every effort to make sure the list is correct, but you should note that products and their ingredients are subject to change. Some of our information comes from third parties therefore we are unable to accept any liability for any incorrect information.

Customers should also ensure that children are suitably supervised to avoid sweeties being chosen which would pose a choking risk. Similar care should also be taken to ensure children’s safety relating to plastic packaging to avoid any risk of suffocation. UpStylePhotos cannot be held responsible for safety issues which occur from the use of equipment, consumables or the consumption of confectionery left at the celebration location.

LED Letters

Client will arrange for an appropriate space(s) for the letters at the events venue. Space must be level and solid.

It is client’s responsibility to ensure suitable access is possible.

Letters may be placed in an exterior location provided it is on a level, solid surface and protected from weather.

UpStylePhotos staff can gain access to the desired set-up area at least 60 minutes prior to the scheduled start time.

Client is responsible for ensuring that a suitable power supply is available for the letters in required location(s). If client does not arrange for provider to fit into a venue, check to ensure access, provider’s choice of location and client did not meet the terms set within this contract, client will forfeit all payments received.

Candt Floss and Pop Corn Machines

Client will arrange for an appropriate space for the cart(s) at the events venue. Space must be level and solid.

It is client’s responsibility to ensure suitable access is possible.

Cart(s) may be placed in an exterior location provided it is on a level, solid surface and protected from weather.

UpStylePhotos staff can gain access to the desired set-up area at least 60 minutes prior to the scheduled start time.

Client is responsible for ensuring that a suitable power supply is available for the cart(s).

If client does not arrange for provider to fit into a venue, check to ensure access, provider’s choice of location and client did not meet the terms set within this contract, client will forfeit all payments received.

UpStylePhotos agrees to have the cart(s) operational for a minimum of 95% of the hire period. Occasionally operations may need to be interrupted for maintenance of the cart(s).

Damage to UpStylePhotos Equipment

Client acknowledges that it shall be the responsible for any damage(s) or loss to the providers equipment caused by any misuse of the providers equipment by clients or client’s guests.

Under no circumstances can any banners or decoration be attached to the sweet cart. Customers are not permitted to stand drinks on the carts as this may result in staining and water damage. Any damage to the sweet carts caused by drinks or glasses will incur a charge.

We reserve the right to remove all equipment, from any event before the end of the hire period, if we deem that the equipment is in danger of damage or if any member of UpStylePhotos staff are faced with abusive or threatening behaviour.

Date Changes and Cancellation

Any request for a date change must be made in writing at least thirty days in advance of the original event date.

Change is subject to availability and receipt of a new service contract.

If there is no availability for the alternative date, time or location, the non-refundable retainer shall be forfeited, and the event cancelled.

If event is cancelled for any reason, the non-refundable reservation fee is forfeited.

Indemnification

Client agrees to, and understands the following:

Client will indemnify provider against any and all liability related to client’s event during or after client’s event.

Client will indemnify provider from the time of service and onto the future, against any liability associated with client.

Client will indemnify provider and all liability associated with the use of pictures taken within UpStylePhotos photo booth, its representatives, employees and affiliates at client’s event.

UpStylePhotos or any representative shall not be liable in respect of damages/injury/loss or any other damage incurred in respect of any hire, as a result of any default or damage to the item(s) the customer shall satisfy themselves of the suitability/condition/placement of the equipment upon receipt.

In no event shall UpStylePhotos be liable to you for any damages resulting from or relating to any failure or delay providing service under this agreement if such delays are due to strikes, weather, fire, riots, theft, terrorism or any other causes beyond our control. Such failure or delay shall not constitute a default in this agreement.

We reserve the right to alter the specification of the equipment where necessary, to comply with regulations or legal requirements all such alterations do not in our opinion affect your expressed requirement. You will be informed of any such alterations prior to your event.

Changes to Contract

The contract you sign constitutes the entire contract between UpStylePhotos and client and supersedes any prior understanding or representation of any kind proceeding the date of this contract.

There are no other promises, conditions, understandings, or other agreements, neither oral or written, regarding the contract.

Client understands and agrees that all sales and service fees are final.

Price Changes

We reserve the right to change our prices at any time. We will honour your original quotation. All quotations are informative rather than legal offers.

Complaints

In the unlikely event of any dissatisfaction on your part, please inform UpStylePhotos within 48 hours of your event taking place. We reserve the right to refuse compensation with any complaint received after 48 hours working days after your event has taken place.

Finally.......

Unless you ask us not to, UpStylePhotos reserves the right to take photographs of the hired equipment and your guests using it for promotional purposes.

Making a booking with UpStylePhotos denotes that you have read, understood and agree with these terms and conditions.

These Hire Contract Conditions may be changed by UpStylePhotos from time to time by UpStylePhotos giving notice of the amendment to the client. Notice is deemed given (whether or not actually received) when UpStylePhotos does any of the following:

Sends notice of the amendment to the Customer at any address (including an email address) supplied by the Customer
